Kidnapping

The California Penal Code defines kidnapping as forcibly or by instilling fear steals, takes, holds or detains another person and moves them into another area without their consent. Kidnapping is a serious felony and carries a penalty up to 8 years in state prison. If the person you are accused of kidnapping is under the age of 14 or suffered death or bodily harm you may face a mandatory sentence of life in prison. The penalty may be less severe if the child under the age of 14 whom you are accused of kidnapping is your biological or adoptive child.
