In California, it is illegal to operate a vehicle with either, (1) alcohol level of .08 or higher or (2) under the influence of another narcotic or drug. After being charged with a DUI, you face criminal charges and suspension of your driver’s license. Drunk Driving Charges

DUI Arrests in Los Angeles usually begin with a traffic stop by a highway patrol officer, or in some cases, occur at a sobriety checkpoint. The officer may ask you to perform a series of maneuvers intended to determine whether you are intoxicated or not. These are called field sobriety tests. Officers may also have you blow twice into a handheld breathalyzer.

Once arrested, you will be taken to the holding cell and asked to take a 2nd test to determine your BAC or Blood Alcohol Content. This usually takes the form of a blood or breath test at the police station, jail or hospital (you’re required by law to take this test…refusing the chemical test may result in tougher California DUI penalties and a one-year drivers license suspension).

Most DUI arrests that are misdemeanors. Usually first offenses and DUI arrests that do not involve an accident of any sort, will end with your release from jail within a few hours of your arrest and booking. You will be given two documents when released, a citation to appear in court, and a temporary license to operate a motor vehicle (the police will keep your actual license). If you’re from out of state and get a California DUI, the police here can’t take your physical license.

They range from first time, misdemeanor offenses, to more serious felony offenses that are the result of a an automobile accident (sometimes even a fatal accident). Q: I failed a breath test, do I have a chance to beat my case?

California Vehicle Code Section 23152

California’s Vehicle Code Section 23152 addresses the offense of driving under the influence of drugs or alcohol. It states:

Driving Under Influence of Alcohol or Drugs

23152. (a) It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.

(b) It is unlawful for any person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle.

For purposes of this article and Section 34501.16, percent, by weight, of alcohol in a person’s blood is based upon grams of alcohol per 100 milliliters of blood or grams of alcohol per 210 liters of breath.
